Specialist Payment Dispute Lawyers for Australian Businesses

Unclear payment terms are one of the most common causes of commercial disputes. When a contract is vague about the price, when payment is due, how it is calculated or what happens if it is late, parties can end up disagreeing over whether an invoice is owed at all. The result is often an unpaid invoice, strained cash flow and a damaged business relationship. We advise businesses across Australia on resolving invoice and payment disputes and recovering what they are owed.

Our team has deep experience with commercial payment disputes, from disagreements over what was agreed to disputes over variations, milestones and deductions. We assess the contract and the history of dealings early, advise on realistic outcomes and pursue the path most likely to get our client paid, whether that’s negotiation, a formal demand or court proceedings. Fixed-fee options are available for defined stages of a matter, and we act nationally from offices in Melbourne, Sydney, Brisbane and Perth.

FAQs

What counts as an unclear payment term, and why does it matter?

An unclear payment term is any provision that doesn’t clearly state the amount, due date, payment method or consequences of late payment, or that can be read in more than one way. It matters because without clear terms, a client can dispute an invoice and the contract may not give a clear answer on who is right.

Allied Legal reviews the contract and the way the parties have dealt with each other to work out what was actually agreed, then advises on the strongest way to pursue or defend the payment.

Typically the first step is a written demand referring to the contract and the invoice, followed by negotiation or mediation. If that fails, you may be able to commence proceedings to recover the debt, with the best option depending on the amount and the strength of the dispute.

Allied Legal prepares and sends the demand on your behalf and recommends the most cost-effective path to recovery, escalating only when it’s genuinely the right step.

You can if the contract provides for it, and in some cases a court may award interest on an unpaid debt even when the contract is silent. The rate and entitlement depend on the contract and the court in which a claim is brought.

Allied Legal checks what the contract allows and includes any available interest in the claim, so you recover the full amount you’re entitled to.

Disputes over extra work usually turn on whether the variation was agreed, whether the contract requires variations to be in writing and what the parties’ communications show. Records such as emails and approvals are often decisive.

Allied Legal gathers and assesses the evidence of what was agreed, and advises on whether to claim for the work or defend against the claim.

Sometimes. Whether a client can withhold or reduce payment depends on the contract, including any set-off or notice provisions, and on whether the alleged defect is genuine. Withholding payment without a proper basis can itself be a breach.

Allied Legal assesses whether the deduction is justified, and pursues or resists it accordingly.

As soon as an invoice is disputed or goes substantially overdue, ideally before the relationship breaks down further. Early action preserves evidence, keeps more options open and improves the chances of getting paid.

Allied Legal reviews your contract and invoices promptly and recommends the quickest practical route to payment.
